These Terms of Service govern your use of Wanderlust Aussie's services and website. By booking with us or using our website, you agree to be bound by these terms. Please read them carefully before making a booking.

1. About Wanderlust Aussie

Wanderlust Aussie Pty Ltd (ABN 12 345 678 901) is a licensed travel agency operating in Australia. We specialise in creating authentic Australian travel experiences including tours, accommodation bookings, and custom itineraries. Our registered office is located at 142 Collins Street, Melbourne VIC 3000, Australia.

2. Booking and Payment Terms

2.1 Making a Booking

When you make a booking with Wanderlust Aussie, you enter into a contract with us. The person making the booking must be at least 18 years old and have the authority to accept these terms on behalf of all travellers in the booking. You are responsible for ensuring all information provided is accurate and complete.

2.2 Deposit and Payment

A non-refundable deposit is required at the time of booking. The deposit amount varies depending on the package but is typically 25% of the total tour cost. Full payment is due no later than 60 days before your departure date. Bookings made within 60 days of departure require full payment at the time of booking.

2.3 Pricing

All prices are quoted in Australian Dollars (AUD) and are subject to availability. Prices include GST where applicable. We reserve the right to adjust prices due to currency fluctuations, changes in government taxes or fees, or significant increases in supplier costs. Once full payment is received, your price is guaranteed.

3. Cancellations and Refunds

3.1 Cancellation by You

If you need to cancel your booking, you must notify us in writing. Cancellation fees apply as follows:

We strongly recommend purchasing comprehensive travel insurance to protect against cancellation fees.

3.2 Cancellation by Wanderlust Aussie

We reserve the right to cancel a tour if minimum numbers are not reached, typically 14 days before departure. In such cases, we will offer you an alternative tour or provide a full refund. We are not responsible for any additional costs you may have incurred such as flights or accommodation.

4. Changes to Your Booking

If you wish to make changes to your booking after confirmation, we will do our best to accommodate your request, subject to availability. An amendment fee of $75 per booking applies, plus any additional costs charged by our suppliers. Changes requested within 30 days of departure may not be possible.

5. Travel Insurance

We strongly recommend that all travellers purchase comprehensive travel insurance covering cancellation, medical expenses, personal accident, baggage loss, and personal liability. Travel insurance is your responsibility, and we are not liable for any losses you suffer that would have been covered by adequate insurance.

6. Travel Documents and Passport Requirements

You are responsible for ensuring you have valid travel documents including passports, visas, and any required vaccinations. Passports must be valid for at least six months beyond your travel dates. We can provide general guidance, but it is your responsibility to check requirements with relevant embassies or consulates.

7. Health and Fitness

Some of our tours involve physical activity such as hiking, camping, or water sports. You must inform us of any medical conditions, disabilities, or dietary requirements that may affect your participation. We reserve the right to decline a booking or remove a traveller from a tour if we believe they are not physically or mentally capable of completing the itinerary safely.

8. Behaviour and Safety

All travellers are expected to behave respectfully and follow instructions from tour guides and local authorities. We reserve the right to remove anyone from a tour whose behaviour endangers themselves, other travellers, or staff. No refund will be provided in such circumstances. You are responsible for your own safety and must follow all safety guidelines provided.

9. Our Responsibilities

We act as an agent in arranging accommodation, transport, tours, and other travel services provided by independent suppliers. While we take care in selecting reputable suppliers, we are not responsible for their acts, omissions, or failure to perform. Our liability is limited to the amount you paid for your booking, excluding airfares.

9.1 Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control including natural disasters, severe weather, pandemics, war, terrorism, civil unrest, strikes, or government restrictions. In such circumstances, we will work with you to find reasonable alternatives but cannot guarantee refunds.

10. Complaints and Disputes

If you have a complaint during your tour, you must notify our tour guide or office immediately so we can attempt to resolve the issue. If you are not satisfied with the resolution, you must submit a written complaint within 30 days of returning from your tour. We will investigate and respond within 14 days.

11. Privacy and Data Protection

We collect and use your personal information in accordance with our Privacy Policy and the Australian Privacy Principles. By booking with us, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

12. Intellectual Property

All content on our website including text, images, logos, and design elements is owned by Wanderlust Aussie or our licensors and is protected by copyright laws. You may not reproduce, distribute, or use any content without our written permission.

13. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any loss or damage arising from your booking is limited to the amount you paid for the relevant booking. We are not liable for indirect, consequential, or special damages including loss of enjoyment, lost time, or disappointment.

Important Notice: Australian Consumer Law provides certain consumer guarantees that cannot be excluded. Nothing in these terms is intended to limit your rights under Australian Consumer Law where such limitation would be prohibited.

14. Governing Law

These Terms of Service are governed by the laws of Victoria, Australia. Any disputes arising from these terms or your booking will be subject to the exclusive jurisdiction of the courts of Victoria.

15. Changes to Terms

We may update these Terms of Service from time to time. The updated version will be posted on our website with a new "Last Updated" date. Bookings are governed by the terms in effect at the time of booking.
